By accessing and using this Website (www.CarbonBuzz.org) ("the Site") you ("the User") agree to these terms and conditions of use:
Purpose of the Site
Purpose of the Site is the provision of a web based software tool for Users which will provide:
- The ability for Users to record target energy use and CO2 emissions through the design phase of their projects using the Methodology.
- The ability to compare these targets with actual energy use and CO2 emissions from completed projects using the Methodology.
- The ability to compare both target and actual energy use and CO2 emissions with other projects
- The ability to publish project energy use and CO2 emission details through the site to address the severe lack of attributable data in the industry.
To provide a means by which the Database may be populated with energy use and CO2 emissions data, amongst other project specific data, and which may be used to publish benchmark category reports and for more general research coordinated by the RIBA and CIBSE
Intellectual Property Rights
The User acknowledges and accepts that there may be copyright works or other content or materials on the Site in which copyright, trade mark, patent, trade secret, or other proprietary rights ('Intellectual Property Rights') are owned by third parties and which are reproduced by permission of such third parties. The User may not copy, sell, rent, lease, license, sub-license, trade under, grant any rights in, transfer, distribute, time-share or otherwise assign to any third party any of the materials or content on this Site or any portion of this Site. Any unauthorised or restricted act in relation to the materials or content on this Site or any portion of this Site may result in civil proceedings and/or criminal prosecution.
CarbonBuzz reserves the right (but shall have no obligation) to pre-screen, review, flag, filter, modify, refuse or remove any or all Content from any Service.
The User acknowledges that any content that the User inputs onto the Site, will automatically be entered into a database, and that this database will be used to conduct research on anonymous project data to identify trends in the energy use of buildings and related factors. This is the Purpose of the CarbonBuzz Project.
CarbonBuzz acknowledges and agrees that it obtains no right, title or interest from the User (or its licensors) under these Terms in or to any content that the User may submit, post, transmit or display on, or through the Site, including any intellectual property rights which subsist in that content (whether those rights are registered or not), whether registered in the UK or any other part of the world.
The User hereby grants an irrevocable, non-exclusive royalty free licence (which licence shall be capable of assignment and sub-licensing) to CarbonBuzz for any use whatsoever for the Purpose of the CarbonBuzz project, of the copyright accruing to the User without CarbonBuzz having to do anything further. Unless the User has agreed otherwise in writing with CarbonBuzz, the User agrees that it is responsible for protecting and enforcing those rights and that CarbonBuzz has no obligation to do so on the Users behalf.
The User agrees that it shall not remove, obscure, or alter any proprietary rights notices (including copyright and trade mark notices) which may be affixed to or contained within the Site.
Unless the User has been expressly authorised to do so in writing by CarbonBuzz, the User shall not use any trade mark, service mark, trade name, logo of any company or organisation in a way that is likely or intended to cause confusion about the owner or authorised user of such marks, names or logos.
Data Protection Act 1998
The Data Protection Act 1998 defines the legal responsibilities of users such as ourselves. The Act governs collection, storage, use and transfer of personal data, for example, the name, address, email, age, etc. CarbonBuzz is committed to protecting the rights of users in relation to personal information and confirm that all personal information submitted by the User will be processed in accordance with the Data Protection Act 1988.
Your passwords and account security
The User agrees and acknowledges that it is responsible for maintaining the confidentiality of passwords associated with any account used to access the CarbonBuzz Site.
The User agrees that it will be solely responsible for all activities that occur under its account.
If the User should become aware of any unauthorised use of its password or of its account, it will notify CarbonBuzz immediately at email@example.com
Accuracy, Use and Feedback
CarbonBuzz are committed to respecting the privacy of Users entering the Site (in accordance with the agreement text on security). We recognise the importance the responsible use of information collected on the Site and we will do our best to maintain the accuracy of the information that the Users supply for use by CarbonBuzz. CarbonBuzz retains the right to appoint a non-competitive academic organisation to audit all the data entered into the site under confidentiality obligations. It will be the role of the auditors to provide regulatory functions for the CarbonBuzz Site and quality assurance of the Data in accordance with the goals of the CarbonBuzz Project.
It is the intention of CarbonBuzz to ensure that all information collected is kept anonymous and no information will be personally identifiable to other users and/or suppliers of the information. CarbonBuzz will publish all research relating to anonymous data to all Site Users and to the wider public through the Site or via newsletters.
CarbonBuzz will automatically gather certain information about the numbers and frequency of visitors to the Site. This information will only be used to determine how Users are utilising the Site. Number of registered practices, projects entered, published projects and publishing practices will be reported on the front page of the Site.
CarbonBuzz publishes the information on the Site for information purposes only and CarbonBuzz does not accept any responsibility for any loss or damage whatsoever, including, without limitation, indirect or consequential loss or damage, or any loss or damages from use, loss of use, or profits arising out of or in connection with the use of the Site.
These terms and conditions shall be governed and construed in accordance with the laws of England and Wales. Any dispute arising under these terms and conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
